Mindful Wing Chun Warning and Waiver

The terms and conditions in this warning and waiver are in addition to any general terms and conditions that the parent or guardian may have agreed to or be subject to due to the use of Mindful Wing Chun Limited’s (“MWCL”) premises or any classes organised by and through MWCL anywhere in Hong Kong.
Herein and throughout this document, “Mindful Wing Chun” refers to the company listed as Mindful Wing Chun Limited (MWCL).

By submitting this form, I confirm that I am the parent or legal guardian of the child named on this form, and I agree to the acknowledgements, terms and conditions set out below on behalf of that child.

Your Child’s Physical Condition and Safety

1. I acknowledge that Wing Chun training can be of a high intensity, and as it involves from time to time vigorous physical activity there is risk of injury, disability, paralysis and even death.

2. I understand and acknowledge that it is my responsibility to consult a physician regarding my child’s ability to participate in MWCL classes; furthermore, it is my responsibility to inform MWCL staff of any injuries or disabilities my child may have prior to training, and also inform staff if my child feels unwell before, during or after participating in a class.

3. My child shall not participate in MWCL classes whilst suffering from any infections or contagious illness, disease or other ailment including but not limited to open cuts, abrasions, open sores or minor infections, where there is any risk that such use or participation in such condition may be detrimental to the health, safety, comfort or physical condition of other participants of said classes; I will bring any such matters to the attention of the staff of MWCL if in any doubt.

4. In addition to the above, if my child is under medication and/or suffering from or having suffered from any medical disability I agree to seek the advice of a qualified medical practitioner before allowing participation in MWCL classes, and my child shall not participate if there is any risk to their health.

Limitation of Liability / Release / Indemnity

1. I hereby acknowledge that I am aware that in participating in MWCL classes, there is the risk or possibility of injury and I fully acknowledge and voluntarily accept these inherent risks on behalf of my child.

2. I take full responsibility for any injury, loss or damage to my child’s person or property that may arise directly or indirectly from participation in MWCL classes.

3. I have consulted a qualified medical practitioner recently and know of no reason why my child should not participate in MWCL classes.

4. My child has no physical or mental restrictions, disabilities or any predispositions to sickness or injury that may be aggravated or adversely affected as a result of participation in MWCL classes.

5. I acknowledge and agree that my child will participate in MWCL classes at all times in accordance with the instructions given by MWCL and I further acknowledge and agree that MWCL will not be liable for any injury or damage sustained if my child participates in MWCL classes before receiving proper instruction or if my child acts contrary to such instruction.

6. To the fullest extent permitted by applicable laws, I hereby agree that MWCL, and its respective servants, agents, officers, employees, assistants, apprentices, independent contractors and members shall not be liable in contract, tort (including without limitation negligence), pre-contract or other representations or otherwise out of or in connection with participation in MWCL classes, for any claims, demands, damages, economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), loss of goodwill or reputation, or special or indirect consequential losses in any case.

7. I hereby agree that I will not now or in the future, directly or indirectly, seek to claim compensation from MWCL, or other participants in MWCL classes, for any injury, loss, costs or damages occurring, or arising from, participation in classes. I hereby release, waive and discharge MWCL, and its respective servants, agents, officers, employees, assistants, apprentices, independent contractors, members and other participants in classes from any claim for injury, loss, costs or damages occurring, or arising from, participation in classes. I hereby agree to indemnify, defend and hold MWCL harmless against any liability, damages, legal fees, or from any other costs incurred in connection with claims caused by my or my child’s negligence or other wrongful acts or omissions, even if MWCL was negligent.

8. I hereby agree to defend, fully indemnify on demand and hold harmless MWCL from and against all liabilities, claims, expenses, damages and losses including legal fees (on an indemnity basis) which MWCL may suffer arising from any breach of these terms and conditions by me, or in connection with any act, omission, default, negligence or conduct attributable to me or my child.

9. I grant permission for images, video and audio of my child’s participation in classes to be used by MWCL for marketing purposes from time to time.
